The Public Utilities Regulatory Authority (PURA) has just ruled that all project information in connection with any ZREC/LREC bids (except bank accounts) will become public information after July 31, 2013, unless and until a project submits a motion for a protective order.

Any large or medium ZREC/LREC project bidders that bid in the first ZREC/LREC solicitation that wish to keep bid information confidential beyond July 31, 2013 must submit to the Authority a Motion for a Protective Order no later than July 22, 2013. The Motion must provide specific legal arguments with reference to state or federal law describing with supporting facts why the information should be kept confidential. A certified affidavit supplied by a competent witness in support of the Motion, a proposed protective order and nondisclosure agreement must be appended to the Motion. The Authority will rule on the Motion forthwith, and it will give further direction as necessary.
